1. Acceptance of Terms
By accessing and using UmpBook ("the Platform"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Platform.
2. User Declarations and Warranties
- I am a bona fide umpire, organisation representative, or administrator authorized to use this Platform
- All information provided in my registration and profile is true, accurate, and complete
- I will maintain the accuracy of such information and promptly update it as necessary
- I am legally capable of entering into binding contracts
- If registering as a minor, my parent/legal guardian has reviewed, approved, and consented to these terms on my behalf
3. Platform Usage
3.1 Permitted Use
UmpBook provides a platform for:
- Organisations to create events, book umpires, and manage payments
- Umpires to receive bookings, manage schedules, and track earnings
- Administrators to oversee and manage the entire system
3.2 Prohibited Activities
Users agree NOT to:
- Provide false or misleading information
- Impersonate another person or entity
- Use the Platform for any illegal or unauthorized purpose
- Interfere with or disrupt the Platform's operation
- Attempt to gain unauthorized access to any systems or data
- Harass, abuse, or harm other users
- Share login credentials with unauthorized persons
4. User Responsibilities
4.1 For Umpires
- Maintain professional standards and qualifications
- Honor accepted bookings and provide adequate notice if unable to attend
- Ensure medical fitness to officiate at events
- Comply with all relevant sports governing body rules and regulations
- Maintain valid accreditations and licenses as required
4.2 For Organisations
- Provide accurate event information
- Make timely payments for umpire services
- Ensure safe event conditions
- Comply with all applicable sporting regulations
- Respect umpire availability and professional boundaries
5. Indemnity and Limitation of Liability
I hereby acknowledge and agree that:
- I participate in umpiring activities and use this Platform entirely at my own risk
- I indemnify UmpBook, its owners, operators, partners, sponsors, and service providers against all actions, claims, damages, losses, or expenses of whatever nature arising from my use of the Platform or participation in any event
- It is my responsibility to be medically fit and adequately insured to participate in sports officiating activities
- UmpBook is not liable for any injuries, damages, or losses that may occur during events
- UmpBook is a booking and management platform only and is not responsible for the actions of organisations, umpires, or event participants
5.1 Platform Liability
UmpBook shall not be liable for:
- Any disputes between organisations and umpires
- Cancellations, no-shows, or breaches of booking agreements
- Payment disputes (though we will assist in resolution)
- Personal injuries or property damage during events
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
6. Payment Terms
6.1 Subscription Fees
Umpires may be required to pay subscription fees as outlined in their subscription plan. All fees are non-refundable unless otherwise stated.
6.2 Booking Payments
Organisations agree to pay umpires the agreed fees through the Platform. UmpBook may charge transaction fees for payment processing.
6.3 Payment Processing
Payments are processed through Payfast, a third-party payment provider. Users agree to Payfast's terms and conditions.
7. Account Termination
UmpBook reserves the right to suspend or terminate accounts that:
- Violate these Terms of Service
- Engage in fraudulent or abusive behavior
- Provide false information
- Fail to make required payments
- Breach applicable laws or sporting regulations
8. Intellectual Property
All content, trademarks, logos, and intellectual property on the Platform remain the property of UmpBook. Users may not reproduce, distribute, or create derivative works without express written permission.
9. Modifications to Terms
UmpBook reserves the right to modify these terms at any time. Users will be notified of significant changes. Continued use of the Platform after modifications constitutes acceptance of the updated terms.
10. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of South African courts.
